Scope

The following terms and conditions contain the conditions applicable between you and ULTRAGRÜN GmbH for booking mountain bike tours, lectures or seminars and for orders via our online shop for consumers and entrepreneurs alike. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. Entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity. If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby contradicted; they only become part of the contract if we have expressly agreed to this.

Terms and Conditions for Ordering Products Online

These are the general terms and conditions for buying physical products online.

Conclusion of contract

On our websites fritzgeers.de and mueslay.de, products can initially be collected in a virtual shopping cart without obligation using buttons. Corrections can be made in the virtual shopping cart using correction tools. By clicking on the "CHECKOUT" button, these terms and conditions are accepted and you are forwarded to the checkout. Contact details, delivery and billing information must be entered here. By clicking on the "Pay Now" or "Complete Order" (as applicable) button, a binding order is placed. The order represents an offer to ULTRAGRÜN GmbH to conclude a purchase contract for the products in the shopping cart. Payment of the purchase price is due at this point. After the order has been placed, an email will be sent confirming that the order has been received. The order is officially accepted by ULTRAGRÜN GmbH when an e-mail is sent confirming that the order has been shipped. At this point, a contractual relationship is created. In the unlikely event that your order cannot be accepted or processed (e.g. because the product is not in stock, the billing information provided could not be verified or shipping was requested to a country to which ULTRAGRÜN GmbH currently does not deliver ), information about this will be sent by e-mail and the payment already made will be refunded.

Shipping and Delivery

The delivery takes place at the following prices for packaging and shipping with DHL:

Free shipping within Germany.

The shipping costs to Austria are a flat rate of €8.90.

Shipping costs to the European Union are €11.90.

The price for shipping to Switzerland is a flat rate of €21.90 up to an order value of €59. The price for shipping to Switzerland then increases by a flat rate of €10 for the next €59 order value (e.g. €85 order value = €31.90 shipping).

It is possible to collect the goods yourself after written confirmation, as long as the goods have not yet left the warehouse. If you wish to collect the goods yourself, please send an email to info@ultragruen.de with a request before placing an order in the online shop. For technical reasons, it is not always possible to collect the goods yourself.

Payment

The following payment methods are available in the online shop:

Credit card: When you place your order, your credit card details will be transmitted at the same time. After the legitimation, your credit card company will be asked to initiate the payment transaction immediately after the order. The payment transaction will be carried out automatically by the credit card company and your card will be charged.

PayPal, PayPal Express: During the ordering process you will be redirected to the website of the online provider PayPal. In order to be able to pay the invoice amount via PayPal, you must be registered there or register first, identify yourself with your access data and confirm the payment order to us. After placing the order in the shop, we ask PayPal to initiate the payment transaction. You'll get more information during the ordering process. The payment transaction is carried out automatically by PayPal immediately afterwards.

Amazon Payments: After clicking the "Pay with Amazon" button, you will be redirected to the website of the online provider Amazon before completing the ordering process in our online shop. In order to be able to complete the ordering process and pay the invoice amount via Amazon, you must be registered there or first register and authenticate yourself with your access data. There you can select the delivery address and payment method stored at Amazon, confirm the use of your data by Amazon and the payment instruction to us. Damage in transit

If goods are delivered with obvious transport damage, please report such defects to the deliverer as soon as possible and contact us immediately. The omission of a complaint or contact has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.

Retention of title

In the case of consumers, we reserve ownership of the purchased item until the invoice amount has been paid in full. If you are an entrepreneur exercising your commercial or self-employed professional activity, a legal entity under public law or a special fund under public law, we reserve title to the purchased item until all outstanding claims from the business relationship with the customer have been settled. The corresponding security rights can be transferred to third parties.

Warranty and Guarantees

Unless otherwise expressly agreed below, the statutory right to liability for defects shall apply. For consumers, the limitation period for claims for defects in used items is one year from delivery of the goods. For entrepreneurs, the limitation period for claims for defects is one year from the transfer of risk; the statutory limitation periods for the right of recourse according to § 478 BGB remain unaffected. With regard to entrepreneurs, only our own information or the product descriptions of the manufacturer that were included in the contract apply as an agreement on the quality of the goods; We assume no liability for public statements by the manufacturer or other advertising statements. If the delivered item is defective, we initially provide a warranty to entrepreneurs, at our discretion, by remedying the defect (repair) or by delivering a defect-free item (replacement delivery). The above restrictions and shortening of deadlines do not apply to claims based on damage caused by us, our legal representatives or vicarious agents

Reservations

We try to keep the product images up to date. Nevertheless, all pictures are to be seen as examples. The actual product may differ from the image in details and combination due to manufacturing.

Liability

We always have unlimited liability for claims based on damage caused by us, our legal representatives or vicarious agents

  • in the event of injury to life, limb or health,
  • in the event of intentional or grossly negligent breach of duty,
  • for guarantee promises, if agreed, or
  • as far as the area of application of the Product Liability Act is open.

In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and the observance of which the contractual partner may regularly rely on (cardinal obligations) due to slight negligence on the part of us, our legal representatives or vicarious agents, the liability is based on the limited to the damage foreseeable upon conclusion of the contract, the occurrence of which must typically be expected. Furthermore, claims for damages are excluded.

Prohibition of assignment and pledging

The assignment or pledging of the customer's claims or rights against the provider is excluded without the consent of the provider, unless the customer can prove a legitimate interest in the assignment or pledging.

Revocation instructions

You have the right to withdraw from this contract within fourteen days without giving any reason. In the case of a contract of sale, from the day on which you or a third party other than the carrier and designated by you take possession of the goods. In the case of a contract for the regular delivery of goods over a specified period of time from the day on which you or a third party designated by you, who is not the carrier, takes possession of the first goods.

In order to exercise your right of withdrawal, you must inform us (ULTRAGRÜN GmbH, Altenauer Straße 35, 38678 Clausthal-Zellerfeld, info@ultragruen.de) of your decision by means of a clear statement (e.g. a letter sent by post or e-mail). to revoke this contract. You can use the attached sample revocation form for this, but it is not mandatory.

We would like to point out in particular that we cannot take back goods that are durable packaged products whose packaging has been opened. Due to health and hygiene aspects, we exclude durable packaged products whose packaging has been opened or the seal has been removed.

To meet the cancellation deadline, it is sufficient for you to send the communication regarding the exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation

If you withdraw from this contract, we will owe you all payments we have received from you, including delivery costs (except for additional costs resulting from your choosing a different type of delivery than that offered by us, have chosen the cheapest standard delivery) immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment. We may refuse repayment until we have received the returned goods or until you have provided proof that you have returned the goods, whichever is earlier.

Conditions for individually planned guiding events

These are the general terms and conditions for individually planned mountain bike tours of ULTRAGRÜN GmbH. These include, in particular, individually planned guided mountain bike tours, individually planned mountain bike riding technique training, individually planned mountain bike camps (multi-day events, in particular with the organization of luggage transfers and hotels) or individually planned personal training. Guide means a tour leader. Tour leaders are named in the following guide. A guide follows the tourism approach of organizing and guiding a group of people on outdoor mountain bike tours.

Object of the contract and conclusion of the contract

By posting information about individually planned guiding events on the pages of the fritzgeers.de website, an offer is made. The offers and prices presented on our website do not constitute binding offers. You can initially make non-binding inquiries about individually planned guiding events via the linked contact options and specify the essential characteristics of your inquiry. After submitting the form, you will either receive an automatically generated email confirming receipt of your request, or you will receive feedback within the next few days by email or telephone. This does not yet result in a contract. If we investigate your request, we will send you an e-mail with further questions about the preparation of an offer by e-mail or contact you in another way (e.g. by telephone). First of all, you can then correct your request and further specify it by informing us of your wishes by e-mail or by other means (e.g. by telephone). You will then receive a binding offer by email. The contract is concluded when you confirm this offer in writing by email. After receiving your confirmation, you will receive another confirmation email from us. We would like to point out that data communication via the Internet cannot be guaranteed error-free and/or at all times given the current state of the art. At guiding events, the opportunity to stop can be offered. The prices for the retreat are not included in the prices offered (self-payers). A lift ticket may be required for bike park training. Prices for lift tickets are not included in offered prices (self-pay).

Payment

The payment for the offer is made immediately after the individually planned guiding event in cash or the amount is due 7 days after receipt of an invoice by (bank) transfer to the account details specified in the invoice. Other payment methods may be offered in some cases. If this is the case, we note the corresponding options in the offer.

Withdrawal and period of performance

In principle, you have the right to withdraw from the concluded contract in the form of a written notice. We know that a hindrance can sometimes arise as a result of force majeure or unforeseeable circumstances and we therefore endeavor to find a fair solution for both contracting parties should the group or individual persons from the group be prevented. Fast feedback and a good exchange helps us to avoid incurring costs for any necessary advance payments in good time or, for example, to cancel booked overnight stays in good time. If costs for necessary advance services can be avoided or, for example, booked overnight stays can be canceled in good time, we are of course willing to change the contract that has already been concluded in such a way that the costs for any advance services that may no longer have been provided or hotel overnight stays that have been canceled are deducted from the total price.

Booked, individually planned guiding events are binding and take place outside in nature in the specified period, whatever the weather. A cancellation will only be made after a joint, written agreement.

Booked, individually planned guiding events must be canceled at least 30 days in advance if the consumer or entrepreneur is unable to attend, otherwise a cancellation fee of 50% of the price contractually agreed in the offer must be paid. If booked guiding events are canceled by the consumer or entrepreneur within the last 14 days before the start of the event, there is an obligation to pay a cancellation fee of 80% of the price contractually agreed in the offer. If you do not show up at the start of the trip, you are obliged to pay a cancellation fee of 100% of the price contractually agreed in the offer.

If individuals are prevented from attending, the prices agreed in the contract will not change and the (group) price agreed in the contract will remain the same.

If an individually planned guiding event is endangered or made impossible as a result of force majeure, e.g. natural disasters, in particular storms, earthquakes, floods, as well as official measures or security risks, it can be canceled prematurely.

The guide is entitled at any time, even at short notice, to cancel the individually planned guiding event without giving reasons and to exclude participants from participating in the individually planned guiding event. If you are excluded after the start of the individually planned guiding event, there is no right to a refund of the price. If, after the start of the individually planned guiding event, you do not make use of individual services that were properly offered to you due to the event being canceled prematurely or for other compelling reasons, then there is no entitlement to a pro rata refund.

Conditions of participation in individually planned guiding events

Participants of individually planned guiding events are aware that mountain biking is a dangerous sport with a high risk of injury. Participation in an individually planned guiding event is at your own risk and it is in your own interest to follow the guide's instructions. It is only possible for the guide to point out foreseeable dangers, but it is not possible to warn of every unforeseeable danger and danger point. A forward-looking, controlled and considerate driving style, which is within the scope of one's own assessment of abilities and skills, is therefore a prerequisite for avoiding falls and for the timely reaction to possible dangers on the part of the participants. Participants are required to point out misjudgments to the guide about the choice of route and skills so that the guide can react accordingly.

Only those who are fully fit to drive can take part in an individually planned guiding event. Any impairment of the ability to drive, in particular due to alcohol, drugs or medication, leads to the exclusion of the individually planned guiding event. Intoxicants such as alcohol and drugs are also not permitted during the individually planned guiding event.

During an individually planned guiding event, the participants are obliged to wear a bicycle helmet and to wear appropriate clothing for the weather and, if necessary, appropriate protective equipment. Each participant is responsible for his own personal equipment. Participants in guiding events must provide sufficient food and drink themselves.

Despite the expert and safe implementation of the individually planned guiding events, accidents cannot be ruled out. By booking individually planned guiding events, participants ensure that they have valid accident and liability insurance at the time of the event and only start the tour if they feel well prepared for the requirements stated in the tour briefing, in particular if they have sufficient training and have good health. Participants in individually planned guiding events are encouraged to avoid overexertion and to cancel the individually planned guiding event in good time if health problems arise.

In the presence of diabetes, respiratory or cardiovascular diseases, pregnancy and complaints in the joint, muscle and musculoskeletal system in general, morbid obesity or other health problems and previous illnesses, participation in individually planned guiding events is only possible possible after consultation with and with a certificate from the doctor treating you.

For participation in an individually planned guiding event, a technically perfect mountain bike and sufficient breakdown equipment are required. Each participant is responsible for his own personal equipment. The guide is not obliged to provide technical support to participants in the event of a breakdown. If the participant has to be transported back or if the individually planned guiding event cannot be completed due to unforeseeable breakdowns, falls or exhaustion, any necessary return transport must be carried out at the participant’s own risk and expense. Any damage or loss of your own or rented mountain bikes and equipment that occurs during the individually planned guiding event must be reported to the guide immediately.

Duty of supervision

In the case of individually planned guiding events with youth groups or persons under the age of 18, the duty of supervision for minors remains with the parents or teachers, youth leaders or other adult persons supervising them. For individually planned guiding events, young people under the age of 18 require written permission or the accompaniment of an adult supervisor.

These are the general terms and conditions for the sale of gift vouchers for individually planned guiding events of ULTRAGRÜN GmbH. Guide means a tour leader. Tour leaders are named in the following guide. A guide follows the tourism approach of organizing and guiding a group of people on outdoor mountain bike tours.

After the fourteen-day period has expired, vouchers for individually planned guiding events can no longer be returned. There is no right to a partial refund if the voucher is not redeemed.

Vouchers for individually planned guiding events are valid indefinitely and can be given to other people as gifts. In order to redeem the voucher, a binding date for an individually planned guiding event must be booked. We reserve the right that unlimited availability of appointments is not given and recommend inquiring about appointments with sufficient lead time. Appointments are binding if a reservation has been confirmed by us in writing.

Individually planned guiding events take place outside in nature on the reserved date, regardless of the weather. Booked appointments must be canceled at least 30 days in advance if you are prevented from attending in order to ensure that the appointment can be rescheduled. A cancellation or postponement of the appointment is only possible after mutual written agreement. If you are unable to attend or do not appear, there is no entitlement to an alternative appointment and the voucher expires. There is no entitlement to a proportionate refund.

If an individually planned guiding event is endangered or made impossible as a result of force majeure, e.g. natural disasters, in particular storms, earthquakes, floods, as well as official measures or security risks, it can be canceled prematurely. The guide is entitled at any time, even at short notice, to cancel the individually planned guiding event without giving reasons and to exclude participants from participating in the individually planned guiding event. In the event of exclusion after the start of the individually planned guiding event or in the event of cancellation, a right to a refund or a right to an alternative date is excluded.

If event documents are delivered with obvious transport damage, please report such errors to the delivery agent as soon as possible and contact us immediately. The omission of a complaint or contact has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.

Withdrawal and period of performance

In principle, you have the right to revoke the contract within fourteen days without giving reasons and to withdraw from the concluded contract in the form of a written notice. Failure

An individually planned lecture event can only be canceled after a joint, written agreement.

Booked individually planned lecture events must be canceled at least 30 days in advance if the consumer or entrepreneur is unable to attend, otherwise there is a cancellation fee of 50% of the contractually agreed price in the offer. If booked, individually planned lecture events are canceled by the consumer or entrepreneur within the last 14 days before the start of the event, there is an obligation to pay a cancellation fee of 80% of the price contractually agreed in the offer.
